Matthew S. C. Moore

Matt is a Director in the Construction/Surety and Litigation sections.  He has been selected to the 2012 and 2013 Texas Super Lawyers & Rising Stars list in the area of construction litigation. Matt joined Coats Rose as a Director in August 2013.

Practice Emphasis

Matt’s law practice focuses on construction litigation and alternative dispute resolution. He represents owners, developers, general contractors, subcontractors and suppliers on a wide variety of construction-related issues, including breach of contract, breach of warranty, mechanic’s liens, contractual and statutory indemnity, payment and performance bonds, collections, fraud, extra work, construction defects, contract termination, differing site conditions, bid protests, bid mistakes, delay and disruption claims, in both the public and private sectors. Matt also regularly drafts and reviews contract documents.

Representative Engagements

  • Successfully represented general contractor in arbitration seeking backcharges in excess of $700,000
  • Successfully represented public works contractor in a Debarment Proceeding by the City of Houston
  • Successfully represented subcontractor in arbitration against claims brought by a general contractor seeking to recover over half a million dollars in backcharges
  • Defense of general contractor in a multi-party, multi-million dollar construction defect dispute
  • Successfully represented clients in bench and jury trials concerning breach of contract claims and construction trust fund violations
  • Defended against and prosecuted temporary restraining orders
  • Represented an owner/developer in a suit against the project architect and the structural engineer concerning architectural and structural design problems with large apartment complex in Austin, Texas
  • Negotiated numerous settlement agreements on behalf of construction suppliers against subcontractors who fail to pay for materials purchased
  • Defense of glass subcontractor in a multi-party, multi-million dollar construction defect dispute
  • Represented concrete subcontractor in connection with a multi-million dollar dispute involving a wrongful termination claim against the general contractor on a major hotel project in San Antonio
  • Represented subcontractor in a multi-million dollar dispute arising out of the construction of liquefied natural gas facilities in Louisiana
  • Successfully represented general contractor in arbitration against an owner concerning delay, change order and increased costs on a design-build project

Legislative Experience

  • Assisted in the drafting of the 2009 revisions to the Texas Construction Trust Fund Statute
  • Testified during public hearing on Senate bill relating to the award of costs and attorney’s fees in certain proceedings concerning mechanics and materialmans’ liens
