HOUSTON – February 28, 2020 – Coats Rose of counsel, Ret. Judge Dwight Jefferson successfully defended a small oil and gas trading company in a Lanham Act trademark infringement case brought by Chevron Intellectual Property LLC and Chevron U.S.A, Inc. The trial was for disgorgement of profits with Chevron seeking $9 million dollars. The Houston federal court jury in U.S. District Judge David Hittner’s court awarded only $1.1 million.
“All in all this was a good verdict for my client,” Jefferson said. “Faced with the liability findings made by the court pre-trial, and the finding of willfulness at trial, the jury’s award of only a small fraction of the disgorgement of profits sought, is significant”.
The jury did not award any damages for uncertainty of profits earned through the defendants’ use of Chevron’s trademarks, which was testified by Chevron’s damages expert at trial to be $2 billion dollars. Chevron was represented by King & Spalding counsel from the firm’s Houston and New York offices.
The case is Chevron Intellectual Property LLC v. Sariel Petroleum LLC, case number 4:18-cv-00158, in the U.S. District Court for the Southern District of Texas, Houston Division.
